I want to know if it is legal to download, and if it is, where I can get it without viruses and things.

Yes, it's free to download. You can get an ISO of the original 1996 CD from the Gallery (http://gallery.xboltz.net/), or (I recommend) Chex Quest 3 (http://www.chucktropolis.com/downloads/ChexQuest3.zip), which includes the first game, plus two sequels.
